Terms of Service

The following terms are a binding agreement between SilentFlame and all of our hosting customers. Please read them carefully before placing an order. By using SilentFlame's hosting services you accept these terms.

[edit] Service and billing

  1. SilentFlame will bill customers for their services and payment will be due in advance of the month the service is to be provided for. If invoices have not been paid fifteen days or more after they have been issues, SilentFlame may at our discretion suspend a customer's account. When an account is suspended for this reason the customer will still be billed and charged as if the account was still active.
  2. SilentFlame will provide the services listed on the package description pages to the best of our ability. Websites will remain online to the world wide web twenty four hours a day and seven days a week. However, should something go wrong and websites go offline, SilentFlame cannot be held responsible for loss of profit, visitors, or any such inconveniences. As a small operation we do our best, and it is hoped customers will accept this.
  3. Customers must regularly take backups of their accounts. SilentFlame does not have the facilities to take such backups and thus if a catastrophic data loss occurred it would be the backup-less customer's responsibility rather than SilentFlame's.
  4. When SilentFlame registers a domain on a customer's behalf, it belongs to them and they may request access to a domain control panel to fill in their own details for the WHOIS database. Domains can thus be transferred to other hosting companies. SilentFlame does not receive any monies from this service and all go to the registrar.
  5. Customers may upgrade their accounts for no fee to another package. Custom packages are offered by SilentFlame on request and pricing of those is at our discretion.
  6. SilentFlame reserves the right to modify the services provided to customers with or without notification to customers.
  7. All customers may cancel their hosting accounts at any time but no refunds can be given due to the nature of the company. Thus all monies paid to SilentFlame are final, except at our discretion over individual cases.
  8. Customers may not attempt to access any data or applications on the server which they have not been given explicit access to.
  9. Shell access is provided entirely at the discretion of SilentFlame. Identification may be requested by parties using this service.

[edit] Acceptable Use Policy

  1. SilentFlame's services may not be used for any acts that would be illegal in the countries of The United States of America (where the server is located) or the United Kingdom of Great Britain (where the company is based). International laws must also be followed. This includes but is not limited to breaching intellectual property and copyright.
  2. No content that would be illegal for minors to view is allowed on SilentFlame. Content that may be deemed 'inappropriate' but has no legal age limit is not restricted.
  3. Spam/bulk-mailing/spamvertising and the like are all strictly forbidden uses of SilentFlame's services.
  4. Customers are responsible for managing their passwords and keeping their account secure. In the event of a security breach SilentFlame cannot be held responsible for any loss of confidential information and customers should be aware of the risk of storing any such information on SilentFlame's services.
  5. Any applications run on SilentFlame's server aside from those supplied to all customers by SilentFlame must be approved by SilentFlame. Customers should e-mail SilentFlame with details of their application to attain permission. The following are never allowed:
    1. IRC servers, clients, bouncers or daemons
    2. Using SilentFlame as any form of proxy server
    3. Using SilentFlame for malicious or illegal activity such as cracking and exploiting other network computers
    4. Forging or unfairly representing message headers
    5. Distributing destructive applications such as viruses and trojans.
  6. As part of this agreement SilentFlame may review a customer's home directory from time to time.

  1. SilentFlame have the right to terminate or suspend an account with no refund if any part of this agreement is broken.
  2. SilentFlame may modify this agreement at any time with or without notification to customers.
